What is Net Overseas Migration (NOM)?

Net Overseas Migration is based on the actual historical data. What prospective migrants seem to be panicking about is Migration Intake, which is a planned limit of Permanent Residency visa grants for a financial year. There is no direct correlation between NOM and Migration Intake as far as I am aware.

NOM is calculated by the Australian Bureau of Statistics and is based on the actual data –  number of international people coming to Australia, staying over here and leaving Australia. It was 232100 between Oct 2018 and Sep 2019.

Migration Intake is a planned level for PR visa grants for a financial year. It is set on 160000 for FY1920

Let’s get into details.

NOM is ‘based on an international travelers’ duration of stay being in or out of Australia for 12 months or more over the 16 month period (12/16 month rule), and is the difference between:

• the number of incoming international travelers who stay in Australia for 12 months or more within 16 months, who are not currently counted within the population, and are then added to the population (NOM arrivals)
• the number of outgoing international travelers (Australian residents and long-term visitors to Australia) who leave Australia for 12 months or more within 16 months, who are currently counted within the population, and are then subtracted from the population (NOM departures)

NOM is the net gain or loss of population through immigration to Australia and emigration from Australia. Migration flows impact on issues such as Australia’s labor supply; national income; housing availability; cultural diversity; and social cohesion. Variations in the volume and characteristics of travelers to and from Australia impact on policy decisions and future planning at all levels of government.

Let’s start this article by stating the obvious: It is an offense against Australian immigration and labor laws to employ, refer or contract an illegal foreign worker in the country.

In some cases, the offense is not just a simple civil case; it can sometimes be criminal in nature.  As such the consequences are scary.

We know, we know.  You don’t want to be branded as an employer of unlawful foreign workers.  For one, it will have an adverse impact on your business and on your dignity as a person.  Secondly, it does not come cheap: the penalty for you as a company can go as high as 200,000 plus AUD per illegal worker.

The sadder thing is, you may still be held liable for the act regardless of whether you know the workers have work rights or not.

The option of hiring non-citizens

Employing skilled foreign citizens can sometimes be the only left for you to resort to, especially at a time when the local labor market of Australia cannot cope with the demand for workers trained and experienced to take on the jobs in your company.

It would have been easier and more convenient to hire local workforce since the requirements are fewer and the process is less cumbersome than to source out talent from overseas.  But this is not possible in a country where economic growth outruns the speed in training its people.

While at that, we are not saying the Commonwealth Government is not doing its part to address the shortage of skilled workers.  On the contrary, it is taking the bull by its horns, so to speak. One measure it is undertaking is the massive training of its citizens geared towards equipping them to assume the roles in the different industries all over the country.  This is the main reason the Skilling Australians Fund (SAF) is instituted.

The downside of it, though, is it may take some more time before they could reach the point where they don’t have to rely on foreign workers to make the many businesses running.

The advantages of employing foreign skilled workers

 While the country is hard pressed to supply the businesses with qualified local workers, skilled foreign nationals are aching to come to Australia to work and make a new start with their family, parents, and relatives.

There are many types of Australian visas.  So, it is but imperative for you to find out which ones provide work rights for their holders.  In so doing, you won’t get into the pitfall of employing unlawful workers.

So, what are the visas whose holders are allowed to work in the country?

• 457 visa or Temporary Skill Shortage (TSS) visa

Visa 457, which is now replaced by Temporary Skill Shortage (TSS) visa, needs no further introduction.  It occupies the top level of the totem pole when it comes to Australian work visas being availed of by foreign workers.  A good number of skilled foreign nationals now enjoying their lives in the country are in a possession of this visa.  Many of them even acquire Australian citizenship in the process.

As if the benefits and privileges of 457 visa or TSS visa are not enough, the dependents of the main applicants are also afforded full work rights in Australia.  These are the spouses or partners of the nominated worker, their children, parents, and even some relatives.

• Student visas

As we have already mentioned earlier, student visas of international enrollees in different universities all over the country have work rights.  The number of hours may be limited while the semester is ongoing, but they can work full time during semester break.  For more information on the work rights of student visa holders, please click student visa working hours.

More on the international students, once they complete their studies in the country, they have the choice to apply for a temporary subclass 485 visa.  This visa has full work rights and may be valid for up to four years depending on the course that the students have completed.

• Holidaymaker visas (Working Holiday and Work and Holiday visas)

Most foreign guests who are here on holidays usually hit two birds with one stone.  While they are here to have a blast, they are also given the right to work full time on short contracts.

• Temporary partner visas

Another precious source of qualified workers for the different industries is the holders of temporary partner visas.  They are granted full work rights.

• Bridging visas

Temporary visa holders who are in a possession of various types of bridging visas constitute another group of non-citizens from whom the local businesses can tap for the needed talent.

The abovementioned types of visa are just some of the many visas that grant work rights to their holders.  There are still many.

The role of VEVO

We know already that this and that visa has work rights while others don’t have.  The question now is this: How can you ascertain if a particular foreign employee of yours has work rights at certain times in the duration of their contract with you?

At the start of their employment with you, you know that their visas have work rights.  The problem is this: You would not have any idea if the status of the visa of your employee has changed while they are working for you.

For example, a worker in possession of a temporary partner visa that has work rights may have separated with their partner, thereby losing their work rights in the process; or a student visa holder who is no longer enrolled in an eligible university; or a dependent of a TSS visa holder whose main applicant just lost their job, and so on and so forth.

Consider yourself lucky if you are an international student who has just graduated from a recognized educational institution here in Australia.  Your choice of this country as the go-to hub when it comes to quality education couldn’t have been better.

Not only have you acquired a world-class schooling from an esteemed university here at lower costs compared to other places in the world, the Commonwealth Government also has prepared a precious gift for you.  This gift is in the form of a visa.  What we are referring to is the Temporary Graduate visa (subclass 485).

Australia may be one of only a few countries in the whole world that provides a world-class educational system to its foreign students while offering opportunities for employment for those who have finished their studies.

While Temporary Graduate visa Australia serves as a way of the government to entice talented graduates to consider taking on jobs here where there is a shortage of local talent, it also proves to be a coveted visa on the part of graduate students as it permits you to live, work, travel or further your studies here after you have completed your chosen course.  In other words, this visa is mutually beneficial for you and for the Australian government.

Speaking of travel, when you apply for subclass 485 here, you would be given a bridging visa so that you can continue to stay in the country legally while your application is being processed.  If in case the bridging visa that’s granted to you is Bridging Visa A, you need to obtain a Bridging visa B if you intend to travel outside of the country.  The immigration department cannot allow you to go out of the country with a Bridging visa A on hand.  You need to have Bridging visa B to be able to do that.

Requirements for Temporary Graduate visa

 If you intend to obtain visa subclass 485, you need to comply with the following requirements:

• You must not be older than 50 years old.
• You possess a qualification in a course listed in CRICOS.
• You have passed the English language requirement.
• In the last six months, you complied with the Australian study requirement.
• You comply with health and character requirements.
• You maintain a health insurance from an Australian provider.
• You must be a holder of an eligible visa.
• You must comply with the requirements of the stream you are applying for.

The last two items on the list need further clarifications.

Eligible visa

Before things get too confusing, let’s discuss eligible visa first in relation to subclass 485.  What do we mean when we say you need to have an eligible visa before you could apply for a Temporary Graduate visa Australia?

This requirement simply means that you are qualified to apply for any stream of subclass 485 if you are in any of the following situations:

• You are a holder of a student visa, but you are not any of the following:
  • A dependent of the main applicant of this type of visa
  • The main applicant who underwent a course under a scholarship or training program under the office of the Foreign Minister or the Defence Minister which requires you to leave the country after you have finished the course.
• You are in a possession of a valid student at any given time during the past six months and you now hold a substantive visa or a bridging visa (it doesn’t matter if it’s Bridging visa A or Bridging visa B).
• You were a holder of a valid student visa that was canceled but was reinstated within the past 28 days after it went through the Migration Review Tribunal.
• You must not have had any cases of visa being refused or canceled since you last entered the country unless you have a substantive visa.

Two streams of Temporary Graduate visa Australia

In reference to the last item of the visa requirements mentioned earlier, subclass 485 has two streams, namely Graduate Work stream and Post-Study Work stream.  Each of these streams has specific requirements to comply with depending on which stream you choose to apply for.

The former is intended for you if you have recently graduated from an Australian school and you possess qualifications and skills that are needed in the medium to long-term in the labor market.  Your skills and qualifications should match an occupation that’s included in the strategic skills list.  This visa is valid for 18 months since the time of granting.

On the other hand, you can avail of the Post-Study Work stream if you have recently graduated from an Australian educational institution where you earned a higher educational degree whatever your field of study is.

This visa is valid anywhere from two to four years.  The validity of the visa depends on the qualification that you use when you apply for this visa.  For instance, a bachelor degree, masters by coursework degree or a master’s degree (extended) can earn for you two years of visa validity.  A master’s by research degree can entitle you to a three-year visa while a doctoral degree can earn for you four years of stay in the country.

Graduate Work stream requirements

Should you decide to apply for Graduate Work stream visa, you need to meet the following requirements:

• You should choose an occupation that’s included in the Medium and Long-term Strategic Skills List (MLTSSL).
• Your application should include proof that you have undergone a skills assessment by a relevant assessing authority for your nominated skilled occupation.
• A relevant assessing authority must find your skills and qualifications suitable for your nominated skilled occupation.
• Again, you must have hurdled the Australian study requirement within the past six months.
• Your skills and qualifications, including the degree, diploma or trade qualification that you use to pass the Australian study requirement must be closely tied to the skilled occupation that you nominated. For instance, you cannot undertake engineering occupations here with a degree in commerce.

This rule is worth noting: You can choose only one occupation and you cannot change that occupation after you have lodged your visa application.

Helpful notes on skills assessment

The responsibility of arranging for the skills assessment falls on you.  You need to find a relevant assessing authority and touch base with them before you lodge your application for this visa.  Finding a relevant assessing agency is important because each assessing body has its own evaluation procedures, schedules, and charges.  Additionally, you need to choose the assessing authority that’s related to your qualifications so that you can obtain appropriate skills assessment.

For instance, if your nominated occupation is nursing, it is but proper that you obtain your skills assessment from the Australian Nursing and Midwifery Accreditation Council or ANMAC.  Or if you are a physiotherapist or an early childhood education teacher, you contact an assessing authority relevant to your qualifications.

Post-Study Work stream requirements

If, however, you happen to have acquired a higher education degree from a recognized institution here and you apply for Post-Study Work stream, here are the requirements that you need to comply:

• Your first Australian student visa should not have been applied for and granted on or before Nov. 5, 2011.
• You are a holder of an eligible qualification that’s conferred on you by an Australian university or, if it is not a university, by an education provider that is registered with the Commonwealth Register of Courses and Institutions for Overseas Students (CRICOS) and that provider has the authority to offer degree courses and above.
• You meet the Australian study requirement within the past six months.

 As far as the application for a Post-Study Work stream visa is concerned, only courses that lead to the awarding of a valid degree will be considered. An eligible degree includes any of the following:

• Bachelor degree
• Bachelor (honors) degree
• Masters by coursework degree
• Masters (extended) degree
• Masters by research degree
• Doctoral degree

 Studies that only confer a diploma level or trade qualification will not be honored.

It is also important to note that your study must be undertaken in a recognized institution of learning.  Otherwise, your application will be refused.

Reminders on health insurance requirements

Just like the skills assessment, you are also responsible for all expenses related to your health while you are in the country.  Unless your country has a mutual health care agreement with Australia, you will not be covered by Medicare — this is Australia’s national health scheme.

The rule here is this: You must have sufficient health insurance coverage if you are not covered by Medicare.  Failure to comply with this requirement could be a cause for visa application refusal or cancellation of an existing visa.

Where to apply?

You and anyone included in your application must be in the country when you apply for this visa and when your visa is decided.

However, your family members who apply for this visa after your own application has been granted do not need to be in Australia when they apply.

No, it’s not.  In fact, it’s something deeper and more complex than that.  It should even interest you if you are thinking of migrating to Australia.

Australian study requirement meaning

Australian study requirement (ASR, for short) can be one of the more complicated topics to explain concerning Australian migration.  The rules, requirements, and mechanics here prove confusing especially to the uninitiated.

This article will try as much as it can to explain it to you in simpler and more understandable terms.

To start off, it is more meaningful and understandable to discuss ASR alongside the concept of General Skilled Migration and Graduate Temporary Subclass 485 Visa.  These are the visas that are immediately impacted upon your completion of the study requirement.

Surely you will ask why you would bother taking the ASR.  There are three key reasons why you should indeed bother undergoing it.  Here they are:

1. You will earn extra points. You very well know that points are such a big help in your quest for an Australian visa, especially the coveted points-based General Skilled Migration (GSM) visas such as Skilled Independent visa (subclass 189), Skilled-Nominated visa (subclass 190) or Skilled-Nominated or Sponsored (Provisional) visa (subclass 489).

You stand to earn five points if you comply with the two-year study requirement (we will discuss in greater detail this two-year study requirement in a bit); another five points are up for grabs if you meet the two years of study in a regional area in the country.  Still another five points can be added to your qualifications if you finish a professional course in Australia.

2. Aside from its value for GSM visa applications, it is equally helpful if you are a student. You can be qualified to apply for a Graduate Temporary Visa subclass 485.  This visa type is as coveted as the GSM visas as it grants you full work rights in the country.  On top of that, you will earn more points while working here.

3. It helps boost your chances for success as far as visa application is concerned. Needless to say, qualifications from an Australian institution are given more weight than those from other sources.

Australian study requirement for skilled migration points test

The next question on your mind right now may be how to comply with the two-year Australian study requirement.  The requisites are as follows:

• You must finish a degree, a diploma, an advanced diploma or a trade qualification. Masters courses, graduate diplomas and Ph.D.’s are counted as degrees, so they can be considered for the ASR.

• The course you complete must be on the list of approved courses for international students. The government has a term for this list.  It’s called Commonwealth Register of Institutions and Courses for Overseas Students or CRICOS.  It goes without saying that if the course you’re going to take here is not included in CRICOS, such course cannot help your need for more points and, as such, qualifications.

• The course must be undertaken in an Australian institution in Australia. This requirement is emphasized because it can happen that you complete a course in an Australian school without necessarily being in Australia.  Examples of this scenario include cases where you study in an Australian school whose campus is outside of the country or if you enroll in a correspondence course of an Australian educational institution while you are in a foreign country.  In cases like these, your course cannot be used to satisfy the Australian study requirement.  The key here is: You must be physically present in the country.

This rule is not etched in stone, though.  There are ways and means when this could be overturned or skirted.  For information on how to do it, we encourage you to keep in touch with a migration consultant at Nowak Migration.

• English should be the medium of instruction.

• In the parlance of the Commonwealth government, two academic years is defined as consisting of at least 92 weeks. This does not mean, however, that you have to spend the whole time studying full-time to comply with the requirement.

The length of time that you spend studying is immaterial here, rather what’s important is the amount of study that you’ve done.  Therefore, it’s okay if it will take you longer than the 92 weeks to finish your studies.  There’s no limit upwards as to how long you can complete your chosen course.  But if you study 100 weeks for a course that’s listed in CRICOS for only, say, 78 weeks, you only get credit for 78 weeks.

On the other hand, if you choose to fast-track the completion of your studies, you should complete it in not less than 16 calendar months.

• Your studies must be in compliance with the conditions of the type of student visa that you are holding, otherwise, your effort will be put to naught.

Documents to attach to your visa application

After successfully completing your course, now comes the time to lodge your application for another type of visa.  Get ready with the required documents.

Below is the list of the documentary proofs showing you have complied with the ASR requirements, which you need to attach to your application:

• Certified true copy of the letter of completion from your school. Together with this are the following:
  • The date the course started and completed
  • The date the course requirements were complied with
  • Location of the school
  • Evidence showing whether the course was undertaken part-time, full-time or it involved any correspondence type of arrangement
  • Language used
  • Certified true copies of transcripts of record

GTE assessment (Genuine Temporary Entrant) is a part of a student visa requirement. Quite often cases officer wants to discuss with a prospective student the reason, why he or she wants to study in Australia. Here’s a first-hand conversation between a prospective student and a case officer.

Dear X, I’m from Australian High Commission, Department of Immigration and Citizenship, New Delhi, India. I’m your case officer Y. Not a big surprise for you that I was your case officer earlier time as well. Do you feel comfortable to answer few of my questions at the moment?

—Yes madam. I have no problem at all

1. What is your full name?
—X

2. Okay tell me your passport number, and where it was issued from?
—Mmm.. It is xxx and it was issued from Ministry of Foreign Affairs, ZZZ

3. Your highest qualification?
— Bachelor degree. I am a fresh BBA graduate from XYZ University.

4. Your IELTS score and subscores?
—Mmm.. Overall band score of 7.5. That is 7.5 in Listening, 8.0 in Reading, 6.5 in writing and 7.0 in speaking.

5. Why you scored just 6.5 in writing while you have exceptional results in other modules? 7.5 hmm.. Brilliant score by the way.
—Yeah, that’s quite low. Task 1 of writing was little confusing and it took me like 5 minutes to think about how to start. I couldn’t manage the given time very well. I had just 20 minutes left when I began writing Task 2. I couldn’t check grammar and spellings in the end of the test. That is probably the main reason that I scored just 6.5 in writing.

6. What was your previous IELTS score?
—Hmmm.. It was 6.5

7. Why are you again applying for Australia?
—Australia is indubitably one of the best countries in the world for higher studies. Since the day I completed my plus two, I wanted to go Australia to further my studies. With a huge hope of pursuing Australian degree, I applied for Australia student visa in May 2012 but that was my bad luck that I couldn’t get visa. Now I am again applying for the student visa. —Well, I was just a high school graduate when I applied for student visa last time. I didn’t know much about the scope of the courses, but now I have graduated my bachelor degree. I am more matured and have understood so many things. I specialized finance in my bachelor program. — Flinder’s is one good university in South Australia. It is centrally located in Adelaide central market just a minute away from Train station. It has 4 metropolitan campuses in Australia. The one where I am applying has the largest number of students, almost 27000.

15. How do you prove yourself as a genuine student?
— I never had gaps in my studies. I was always serious towards my studies. The transcripts and certificates from school till university shows that I am a genuine student.

16. Why did you apply by yourself without any help from educational agent?
— Well I had been to many consultancies but nobody showed interest on my documents. But I was never sad because I knew someday I will reach the point where I always dreamt to be. So I started applying myself. The international student officer at Flinder’s was so supportive that he helped me a lot with admission and all.

16. Give me some guarantees that you’ll come back to Nepal after study.
— Well, my only motive to Australia is for study. I want to get a degree from there and establish myself as a good example of accounting expert in Nepal. And you know I am the only son of my parents, so I have many responsibilities towards them as they are already old, so I have to come back to look after them and take care of their property.
